1. Introduction
Welcome to GrabZWay. GrabZWay is a rental marketplace platform that connects customers with rental businesses (referred to as "Organisations" or "Branches"). These Terms and Conditions outline the rules and regulations for the use of GrabZWay's platform and services. By accessing this website and/or using our services, you accept these terms and conditions in full.
2. Account Registration
- You must be at least 18 years old to create an account and use our services.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and complete information during registration and to update it as necessary.
- GrabZWay reserves the right to suspend or terminate accounts that violate these terms.
3. Rental Terms
- All products listed on GrabZWay are owned and managed by individual rental organisations and branches.
- Product availability is subject to the stock maintained by each branch and can be checked in real-time on the platform.
- Rental periods are defined by the start date and end date selected at the time of booking. You are responsible for returning the product by the agreed return date.
- Late returns may be subject to additional charges as determined by the rental organisation.
- You are responsible for the product during the rental period and must return it in the same condition as received, except for normal wear and tear.
4. Payments, Deposits & Fees
- All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise.
- Payment is made directly to the rental branch. Accepted payment methods typically include Cash, UPI, and Bank Transfer, and may vary by branch.
- A refundable security deposit may be required at the time of rental. The deposit amount is displayed on the product page and is collected by the branch.
- The security deposit will be refunded upon return of the product in its original condition.
- Additional charges may apply for extended rental periods, damages, or late returns as per the branch's policies.
5. Cancellation Policy
- You may cancel your rental order before it has been confirmed by the branch without any cancellation fee.
- Once the branch has confirmed and prepared the order, cancellation may be subject to charges as determined by the branch.
- For cancellations after the product has been picked up or delivered, please contact the branch directly to arrange an early return. Refunds for unused rental days are at the discretion of the branch.
6. Delivery & Pickup
- Products can be picked up from the branch or delivered to your address, depending on the options offered by the branch.
- Delivery timelines and charges, if any, are determined by the branch and will be communicated at the time of booking.
- At the end of the rental period, the product must be returned to the branch or made available for pickup as agreed.
7. Platform Role & Limitation of Liability
GrabZWay acts as a marketplace platform connecting customers with rental organisations. GrabZWay is not the owner of the products listed and is not a party to the rental agreement between the customer and the organisation. GrabZWay shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our platform, or from any transaction between customers and rental organisations.
Important Disclaimers
- Courier & Delivery: GrabZWay is not responsible for any damage, loss, or defect to products if the courier or delivery is arranged and managed by the customer or the organisation independently. Any claims related to such damages must be resolved directly between the customer and the organisation or the courier service provider.
- Payment Management: GrabZWay is not responsible for the management, disputes, or reconciliation of payments if the payment is handled directly between the organisation and the customer — including but not limited to cash payments, direct bank transfers, or any other mode of payment managed outside of the GrabZWay platform.
- Organisation-Specific Policies: Terms and conditions, rules, and return policies may also be defined by each organisation and their respective branches. Customers are advised to review the policies mentioned by the organisation before confirming a booking.
8. Changes to Terms
We reserve the right to modify these terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after such changes constitutes your acceptance of the new terms.
9. Governing Law
These terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat.
